Terms of Use

Skyminator · Version 2026-10-17-dto · As of 17 October 2026

This is a convenience translation. The German version („Nutzungsbedingungen") is the legally binding one; in case of any discrepancy the German wording prevails.

Skyminator is a logbook, telemetry and planning application for glider, microlight and powered-aircraft pilots, winch operators, flight instructors and clubs. These Terms govern the rights and obligations between you and Diebold IT GmbH when you use Skyminator.

Skyminator is an aid, not an avionics system. We accept no liability for flight preparation and the conduct of flights. Every pilot is solely responsible for preparing and conducting each flight properly. See § 9.

§ 1 About Skyminator

Skyminator consists of a mobile app for Android and iOS, a web interface at skyminator.com and a backend service with our own AI infrastructure. The operator is Diebold IT GmbH, Donaustraße 6, 88239 Wangen im Allgäu, Germany (address and representation: see legal notice). "We" in these Terms means Diebold IT GmbH. The features include automatic flight detection, the logbook with digital signatures, the map with airspace, traffic and weather, route planning with route briefing, fuel stops and entry advice per country, winch telemetry, ATIS retrieval, club features with a Vereinsflieger connection, the workshop and aircraft-logbook module, and setting up and managing training organisations with document templates.

§ 2 Availability, currency of data, no warranty

Skyminator is under continuous development. Features may be added, changed or removed; data formats may still change. Uninterrupted availability is not guaranteed. Maintenance windows and outages are possible; the server is usually switched off at night. We strive for stable operation but do not owe any particular service level.

No entitlement to retention of your data. There is expressly no entitlement that your data, in particular flights, logbook entries, sensor recordings and master data, remain permanently stored or available. Data may be deleted or lost during migrations, schema changes or technical maintenance. We try to avoid this and to give notice before planned interventions. Back up important records such as your FCL logbook regularly via the export function.

External sources. Airspace, aerodromes, reporting points, traffic patterns, obstacles, NOTAM, METAR, TAF, SIGMET, weather models, AIP charts, radio frequencies, ATIS recordings, refuelling options and the advice on entry rules and microlight regulations per country come from official and public sources, from Vereinsflieger and from reports by other users. They may be outdated, incomplete or wrong. The entry and microlight advice is researched information, not legal advice. Only the official publications (AIP, NOTAM, weather services, authorities) are binding. Check them yourself before every flight.

§ 3 Who may participate

Skyminator is aimed at pilots, student pilots, winch operators, flight instructors and clubs in general aviation. A Vereinsflieger account is recommended but not required. Minors may use the service only with the consent of their legal guardians; the age limits of the respective training apply (microlight from 16, gliding from 14). We reserve the right to suspend individual accounts where this is necessary for orderly operation.

§ 4 Account, login and connections

You create a Skyminator account with an e-mail address and password. Passwords are stored exclusively as a bcrypt hash. If you lose access, you receive a reset link at the stored e-mail address. You are responsible for keeping your credentials confidential; passing them on to third parties is not permitted.

Optionally you connect your account to Vereinsflieger. Your Vereinsflieger password is stored encrypted, never in clear text. Depending on your club's configuration, your own device performs requests to Vereinsflieger on your behalf ("This device may transfer flights"); you can switch this off at any time. Optionally you connect WeGlide to publish flights there.

§ 5 Prices

Skyminator is currently free of charge; you owe us no consideration for its use. We expressly reserve the right to charge a fee for the service or for individual features in the future, or to change a pricing model. Any such fee and any material change will be announced at least four weeks before it takes effect, in the app and by e-mail; the new version takes effect under § 10. You may terminate extraordinarily within that period; without your consent no payment obligation arises.

§ 6 Data and rights of use

Skyminator depends on being able to analyse as many real flights and sensor recordings as possible. From these data we train our algorithms and our own AI models and develop the service further. By using Skyminator you expressly agree to this use within the scope described here. If you do not want this, Skyminator is not the right offering for you.

§ 6.1 Which data

The Privacy Policy lists in detail which data we process and when. Essentially: master data and licence or medical status, logbook entries with signatures and hash chain, GPS tracks and acceleration, vibration, pressure and audio telemetry during active flights, winch telemetry, and diagnostic and error logs from the device.

§ 6.2 Rights of use and exploitation

You grant Diebold IT GmbH a licence, unlimited in time and territory, transferable, sublicensable and free of charge, to all data you submit via Skyminator. This licence includes the right to store, reproduce, edit, anonymise and aggregate the data and to use it to train and improve our AI models for flight, seat, winch and aerotow detection, polars and weather matching. From the data we may create, publish, license to third parties and commercially exploit anonymised and registration-related data products, and use the data for internal statistics, quality assurance, training and research. Ownership of your personal records, such as your logbook, remains with you. The licence does not include passing personal data to third parties for commercial purposes; this does not take place (see Privacy Policy § 4.3).

§ 6.3 Revocation

You can end the use at any time by terminating your account (§ 8). Data that has already been anonymised or aggregated, and AI models trained with your data, cannot be retroactively removed from the model. Personal raw data is anonymised or deleted according to the periods stated in the Privacy Policy.

§ 7 Your obligations

No automated use. You undertake not to access the app or the backend with automated tools. Prohibited in particular are scraping, bots, crawlers, headless browsers, own API scripts, reverse engineering of the endpoints and mass export or import outside the official functions. Legitimate integrations, for example for club administration or research, require our prior written consent. In case of violation we may block access without notice.

Flight preparation and conduct of the flight. You prepare every flight yourself and completely and conduct it on your own responsibility. Skyminator replaces neither certified avionics nor flight preparation under the applicable rules, crew briefings, the study of AIP, NOTAM and weather in their original form, obtaining clearances and entry permits, or the radio traffic itself. Route briefing, altitude suggestions, detours, fuel stops, flyability assessment, entry and microlight advice are suggestions and information that you verify before every use.

Club features. If you connect your account to Vereinsflieger or use the Vereinsflieger synchronisation, Skyminator communicates with Vereinsflieger on your behalf, depending on configuration also directly from your device and with your Vereinsflieger credentials. You are responsible for being permitted to perform this communication, for your access being valid and for complying with the Vereinsflieger terms. We do not check this permission. You are answerable for entries that are created, changed or deleted in Vereinsflieger in the process. Club administrators, workshop managers and heads of training are responsible for the data and rights they grant within their club.

Winch, traffic and sharing. If you switch on winch telemetry, the traffic display or sharing of the whole flight, position and speed data from your device is transmitted to other users at the same airfield, in the same club or nearby. You decide yourself whether and when you want this.

ATIS retrieval. The retrieval calls exclusively public, freely accessible ATIS telephone numbers and transcribes the announcement. The transcript may be wrong; it does not replace listening to the ATIS or the radio yourself.

Logbook and proof. The correctness of your logbook entries, experience proofs and signatures is your responsibility. Skyminator supports you with plausibility checks and signatures but does not replace your own responsibility under AMC1 FCL.050. You are responsible for proving licence, ratings and experience to the competent authority on request; keep your device ready for that or keep an export at hand. We owe neither the availability of your device nor its power supply.

Training organisations and document templates. Where Skyminator supports you in setting up or operating a training organisation, for example with templates for an organisation manual, safety policy, training programmes, forms and the declaration under Part-DTO, these templates, the documents generated from them and all texts, values and notes they contain are non-binding suggestions only. They are not legal advice, not programmes reviewed or approved by an authority, and no assurance that the documents comply with the rules applicable to your organisation, are complete or will be accepted by the competent authority. Rules and administrative practice change and differ between states and authorities. You review every document technically and legally before using it, adapt it to your organisation and are solely responsible for its content. This applies in particular to the representative and the head of training, who are responsible for the organisation and the training under Part-DTO. You check the data Skyminator uses to pre-fill the documents (such as persons, licences, instructor certificates, aircraft, aerodromes) for accuracy and currency. If you sign a declaration or document in Skyminator or send it to an authority via Skyminator, you make that declaration in your own name and under your own responsibility. Whether the authority accepts an electronically drawn signature and whether a submission has reached it is for you to clarify with the authority. For the documents Skyminator generates for your organisation you receive a simple, unlimited and royalty-free right to use, modify and pass them on for your organisation, including to authorities.

Rights of third parties. Do not infringe the rights of third parties, including copyrights and personal rights of fellow pilots and club members. Manipulating third-party flight data, circumventing technical protection measures and sharing your own access are prohibited.

Please report errors. We depend on your feedback. Write to info (at) diebold (dot) it.

§ 8 Termination

You can terminate your account at any time: in the app under More → Delete account, via the web form at skyminator.com/account/delete or informally by e-mail. We may terminate the contract for good cause, in particular if you systematically violate these Terms, endanger other users, manipulate their data or misuse the platform. We may discontinue the service or individual features at any time and will give timely notice in the app and by e-mail.

§ 9 No liability, responsibility of the pilot

§ 9.1 The pilot is responsible

Responsibility for the proper preparation and the safe conduct of every flight lies exclusively with the pilot-in-command, as the rules of the air (in particular SERA.2010 and the national rules) provide. This applies without restriction when Skyminator is used. Every value shown by Skyminator, every warning, every detected flight state, every route, altitude or fuel suggestion, every entry and microlight note, every weather analysis and every ATIS transcript must be checked by the pilot on their own responsibility before any decision is based on it. An automatically generated logbook entry does not replace your own responsibility under AMC1 FCL.050.

§ 9.2 Skyminator is an aid

Skyminator is an assistance application and not a certified avionics, navigation or collision-warning system. Skyminator is not approved for safety-critical flight decisions and must not be used as the sole basis for decisions in flight operations. Wrong, incomplete or misleading data must expressly be expected: algorithms, AI models and heuristics are under development; the ATIS transcript may render the announcement incorrectly; AI-assisted suggestions and classifications may be inappropriate; flight detection may miss or falsely report take-offs or landings; airspace, traffic and weather data and external sources such as AIP, NOTAM, METAR, OpenFlightMaps, openAIP, weather models, ATIS or Vereinsflieger may be outdated or wrong; traffic displays show only part of the traffic; document templates and the documents generated from them may be outdated, incomplete, wrong or unsuitable for your organisation. You acknowledge this when you register.

§ 9.3 No liability for free use

Skyminator is provided to you free of charge; we receive no consideration for its use. Therefore, as the law provides for gratuitous services (§§ 521, 599, 690 of the German Civil Code applied accordingly), we accept no liability for damage arising from the use of Skyminator unless we caused the damage intentionally or through gross negligence. This excludes in particular liability for damage from relying on displays, warnings, suggestions and analyses, from unavailability of the service, from faulty external data sources, from data loss, for lost profit, lost flight time, consequential costs of incorrect automatic analyses, incorrectly rendered ATIS announcements and instructions, incorrect logbook or Vereinsflieger entries, for damage from violations of airspace rules, entry regulations or flight-preparation duties, and for damage from using document templates and the documents generated from them, in particular from their incompleteness or lack of compliance with applicable law, from rejection, objection or prohibition by an authority, from fines and official measures against you or your organisation, and from submissions to authorities that are not received or received late.

§ 9.4 Mandatory statutory liability

The law does not permit excluding liability for intent or for injury to life, body or health; liability under the Product Liability Act likewise remains unaffected. To that extent we are liable under the statutory rules. Relying on Skyminator contrary to § 9.1 and § 9.2 is at your own risk and is not a circumstance for which we are responsible.

§ 9.5 Future paid plans

Should we charge a fee under § 5, the following applies to paying users instead of § 9.3: for slight negligence we are liable only for the breach of essential contractual obligations (cardinal obligations) and limited in amount to the damage typically foreseeable for this type of contract; § 9.1, § 9.2 and § 9.4 apply unchanged.

§ 10 Consent, versioning and changes

§ 10.1 Consent on registration

By registering you expressly agree to the current version of these Terms and of the Privacy Policy. Which version you accepted is stored with timestamp, IP address and user agent in our consent log (burden of proof under Art. 7(1) GDPR).

§ 10.2 New versions

We may amend these Terms. Material changes, in particular to §§ 5, 6 and 9, will be announced in text form at least four weeks before they take effect, by app notification and by e-mail. The current version is available at https://skyminator.com/agb.

§ 10.3 30-day period for existing users

When a new version takes effect, you have 30 days from the publication date to agree to it. During this period we show a notice in the app and on the web; use remains unrestricted until the end of the period.

§ 10.4 Your right of extraordinary termination

If you do not agree with the new version, you may terminate your account extraordinarily within the 30-day period. The termination takes effect immediately. For future paid plans we refund the proportionate amount for the unused period.

§ 10.5 Right of extraordinary termination of Diebold IT GmbH

If you neither agree after the period has expired nor terminate yourself, we are entitled to terminate the contract extraordinarily for good cause and to block your account. Before blocking you receive a reminder by e-mail and in the app.

§ 11 Language versions

These Terms are available in German, English and Georgian. The German version is legally binding; the translations serve understanding. In case of discrepancies the German wording prevails.

§ 12 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory protective provisions of their state of residence remain unaffected. The place of jurisdiction is, where permissible, the seat of Diebold IT GmbH in Wangen im Allgäu. The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision of these Terms be invalid, the remainder of the contract remains valid.
